Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and GymSentry, operated by Sammy Shires ("GymSentry," "we," "us," or "our").

By accessing or using GymSentry (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

GymSentry is a predictive retention and performance intelligence system for gyms that:

• Collects weekly member check-in data (energy, motivation, progress, pain levels)
• Analyzes responses and attendance patterns
• Predicts churn risk, injury risk, and growth potential
• Generates daily action lists for coaches/gym owners
• Provides pre-written coaching messages for member outreach

2. Account Registration & Security

To use GymSentry, you must:

• Provide accurate, current, and complete information
• Be at least 18 years old or have parental consent
• Have authority to bind your gym/business to these Terms
• Maintain the confidentiality of your login credentials

You are responsible for all activities that occur under your account.

3. Subscription & Payment Terms

Pricing

• Pilot Program: $500 for 90 days (one-time fee)
• Standard Subscription: $249/month (billed monthly)

Refunds

• Pilot Program: Money-back guarantee if you don't save at least 3 cancellations
• Standard Subscription: No refunds for partial months

Prices are in USD and subject to change with 30 days notice.

4. Acceptable Use Policy

You May:

• Use GymSentry to manage member engagement and retention
• Track member check-ins and attendance
• Generate action lists and member communications

You May NOT:

• Violate laws or regulations
• Attempt to hack or reverse engineer the Service
• Share your account credentials with unauthorized users
• Use the Service for gyms you don't own or have authorization to manage
• Upload false or fraudulent information
• Resell or redistribute the Service

5. Data Ownership & Usage Rights

You own your data. You retain full ownership of all member data you input.

You grant us a limited license to store and process your data to provide the Service and improve our algorithms.

GymSentry retains all rights to the software, code, algorithms, brand name, and trademarks.

6. Privacy & Data Protection

Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms.

We implement reasonable security measures including encryption, access controls, and SOC 2 Type II certified hosting.

7. Warranties & Disclaimers

We warrant that GymSentry will function substantially as described. However:

GYMSENTRY IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do NOT guarantee specific retention rates or business outcomes. Member retention depends on many factors beyond our control.

8. Limitation of Liability

OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

We are NOT liable for:

• Lost profits or revenue
• Loss of business opportunities
• Member cancellations or retention rates
• Indirect, incidental, or consequential damages

9. Cancellation

You may cancel at any time with 7 days written notice to sammy@gymsentry.com.

Upon cancellation, access terminates and you may request data export or deletion.

10. Dispute Resolution

These Terms are governed by the laws of Tennessee. Disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules.

You waive any right to participate in class actions or jury trials.

11. Modifications to Terms

We may modify these Terms at any time with 30 days email notice. Continued use after changes constitutes acceptance.
